General

  • Candidates are nominated in a nonpartisan primary election.
  • The candidates receiving the highest number of votes in the primary election are placed on the general election ballot.
  • The candidate who receives the highest number of votes in a nonpartisan general election is elected to the North Dakota Supreme Court.

Interim Vacancies

  • The Governor shall fill any vacancy in the office of supreme court justice or district court judge by appointment from a list of candidates nominated by the judicial nominating committee, unless the governor calls a special election to fill the vacancy for the remainder of the term.
  • Except as provided in subsection 2, an appointment must continue until the next general election, when the office must be filled by election for the remainder of the
    term.
  • Judicial Election

    Judges are elected by popular vote.
  • Democratic Appointment

    Judges are appointed directly by a democratic body, or appointed by the governor with the advice and consent of some democratic body.
